Common HOA Problems
Homeowners Associations (i.e., nonprofit mutual benefit corporations), are a staple of affordable and desirable housing in California. Whether you’re buying a high-rise penthouse, a mansion in a gated community, or a cozy townhouse, very few people understand what they’re getting themselves into. An HOA’s governing documents are usually long, dense, legally inscrutable even to most lawyers, and often out of step with the current legal landscape. If you’re in a dispute with your HOA, the Law Office of William Stanger may be able to help.
Here are the sorts of HOA issues Bill handles most often:
- Damage coming from the common area, such as a roof leak damaging your unit, or a fallen tree or broken sewer line;
- Failure to repair fire-damaged units, either at all, or within two years;
- IDR/ADR (“Internal Dispute Resolution,” and “Alternative Dispute Resolution”). You’ve tried working your disagreement out informally, but now you want legal representation to preserve your rights before anyone files a lawsuit;
- Disciplinary disputes. The law is constantly evolving on this front, and not every HOA stays as up to date as it should on when and how fines work, or worse, when or how to sue in court; and
- Unfair and unreasonable rental restrictions.
Unlike his other practice areas, Bill only represents owners (members) in HOA disputes.
If you have one of these problems, or something similar, please let The Law Office of William Stanger know by calling us at 408-883-8466.
